In future, operators of online shops must provide a digital withdrawal function for most distance contracts concluded with consumers via websites or mobile applications. The consumer must be able to submit his or her notice of withdrawal by activating a clearly designated “withdrawal button”.
The withdrawal function must remain continuously available on the website or mobile application throughout the entire withdrawal period and must be easily accessible to consumers.
Online shops are required to label the withdrawal button with the wording “Confirm withdrawal” or another equally clear and unambiguous formulation.
The withdrawal button must be made available both to registered customers and to guest purchasers, that is to say, in principle, without requiring the consumer to log in.
The implementation of the withdrawal button entails adjusted information obligations, including the provision of an updated notice of the right of withdrawal. A legally compliant implementation may present affected online shops with certain technical challenges. Operators should therefore commence implementation without delay.
