Professional designation\/professional regulations<\/strong><\/h3>\n\n\n\n

The professional designation Rechtsanwalt <\/em>or Rechtsanw\u00e4ltin <\/em>[lawyer] (Federal Republic of Germany)is conferred upon members of society on the basis of legal standards for the Federal Republic after having passed a second state legal examination and undergone a special approval process. This approval process is completed by the relevant Justizministerium <\/em>[Ministry of Justice], by the president of the Oberlandesgericht <\/em>[Higher Regional Court] responsible for their place of residence and on the basis of the respective local Rechtsanwaltskammer\u2019s <\/em>[bar association] legal situation, changed as of 08 September 1998 (see above, under \u201cAuthorisation\/regulatory authority\u201d). They are subject to the professional regulations in the Bundesrechtsanwaltsordnung <\/em>[Federal Lawyers\u2019 Act] (BRAO), the Rechtsanwaltsverg\u00fctungsgesetz <\/em>[Lawyers\u2019s Compensation Act] (RVG), the Berufs- und Fachanwaltsordnungen der Bundesrechtsanwaltskammer <\/em>[the national bar association\u2019s Attorneys\u2019 and Legal Specialists\u2019 Rules of Professional Conduct] (BORA and FAO) as well as the Standesregelung der Rechtsanw\u00e4lte in der Europ\u00e4ischen Gemeinschaft<\/em> (Code of Conduct of the Council of Bars and Law Societies of the European Union (CCBE \u2013 Code of Conduct).<\/p>\n\n\n\n

The professional regulations for the approval to become \u201can EU lawyer based in Germany\u201d are located in Article 1, Part 2, Section 1, Paragraph 2, Sentence 1 in the law on implementing the European Community\u2019s guidelines on the regulation of the legal profession from 09 March 2000, as well as in the Gesetz \u00fcber die T\u00e4tigkeit europ\u00e4ischer Rechtsanw\u00e4lte<\/em> [Act on the Activities of European Attorneys in Germany].<\/p>\n\n\n\n

The professional designation Notar <\/em>or Notarin <\/em>[notary] is conferred upon members of society on the basis of uniform professional regulations (Bundesnotarordnung <\/em>[Federal Notary Code] [BNotO]) in the respective state in which the notary is appointed. They are subject to the provisions of the Beurkundungsgesetz <\/em>[German Notarisation Act] as well as the Gerichts- und Notarkostengesetz <\/em>[Court and Notaries\u2019 Fees Act] ([GnotKG]).<\/p>\n\n\n\n
